Public Offer for Buyers

Public Offer for Buyers

This is an earlier version of the document. Open the version in force

This offer is the proposal of the sellers who sell goods on the Moonberry marketplace (https://moonberry.am; the "platform") to make a contract of retail sale on the terms below. The platform is run by MOONBERRY LLC (TIN 03594126, state registration 999.110.1611928, address: Street 6, Building 21, Apartment 55, Zovuni village, Nairi community, Kotayk Province, 2406, Armenia; "Moonberry").

The offer follows Articles 451–457 and 508–513 of the Civil Code of the Republic of Armenia (the "Civil Code") and the Law of the Republic of Armenia on Consumer Rights Protection (the "Consumer Law"). The Armenian text is legally binding; texts in other languages are translations.

1. Who makes the contract with whom

1.1. The contract of sale is made between the buyer and the seller of the goods. The seller is an individual entrepreneur or a company registered in Armenia; its name, legal form, TIN and address are shown on the product page (the "Seller" tab), at checkout and in the letter about the order.

1.2. Moonberry is the operator of the platform. On the seller's instructions, Moonberry takes the payment, passes the order to the seller and to the delivery service, refunds the buyer, and receives return requests and claims and passes them to the seller. The seller can be reached through Moonberry: in your account, by email at info@moonberry.am and by phone at 37433060333.

1.3. One order may hold goods of several sellers. A separate contract is then made with each of them, and each seller's goods come in a separate parcel.

2. Information about the goods

2.1. The product page shows the name, the main characteristics, the price, availability, the seller and photos. Photos show what the goods look like; colours on screen may differ slightly from the real ones.

2.2. Prices are in Armenian drams and include the taxes the seller must pay. The delivery cost is shown at checkout, before the order button.

2.3. A struck-through price is the seller's previous price. The seller is responsible for it being genuine.

3. Placing an order — accepting the offer

3.1. An order is placed by a registered buyer: they choose goods in the cart, name the recipient (name and phone) and the Haypost office the parcel goes to.

3.2. Before the order button, the page shows everything Article 10.2 of the Consumer Law requires: the sellers, the goods and prices, the delivery cost, how and by when to pay, the conditions of withdrawal and what it costs the buyer, the period for claims about quality, how to complain, and links to this offer and the Privacy Policy.

3.3. By pressing the "Order with obligation to pay" button, the buyer accepts the offer. From that moment the contract is made, and the buyer must pay for the order within the time in clause 4.2.

3.4. Moonberry keeps which version of the offer the buyer accepted, when and from which address, and what was shown to them before the button. Right after the order the buyer receives a letter with the order number and the file "Terms of order" — a copy of the terms shown and the full text of the accepted offer. The same file can always be opened on the order's page in the account.

4. Payment

4.1. Orders are paid by bank card on the bank's secure page. Card details are entered only on the bank's page; Moonberry neither receives nor stores them.

4.2. An order must be paid within 25 minutes after it is placed: the goods are held for the buyer for that long. An unpaid order is cancelled automatically, the contract ends, and there are no consequences for the buyer.

4.3. Moonberry takes the money on the seller's instructions. Payment counts as made once the bank confirms it.

5. Delivery

5.1. Goods are delivered by Haypost, the Armenian post, to the office the buyer chose. There is one delivery cost per order, shown at checkout; if the goods total reaches the threshold shown at checkout, delivery is free.

5.2. The seller hands the parcel to delivery by the date shown in the order — one to five working days after payment. The goods are delivered no later than 30 days after the contract is made (Article 24.10 of the Consumer Law). Where the parcel is can be seen on the order's page in the account; when it reaches the office, the buyer receives a letter and an SMS.

5.3. If the goods are not delivered within that time, the buyer may require delivery within an additional agreed period, and if they are still not delivered, withdraw from the contract and get back all the money paid, plus compensation for losses.

5.4. If the seller has not handed the parcel to delivery even a day after the deadline, the platform cancels that part of the order itself and refunds it.

5.5. The parcel is collected at the office by the recipient named in the order, under Haypost's rules. The risk of accidental loss of or damage to the goods passes to the buyer when they collect the parcel.

5.6. The parcel is kept at the office for Haypost's storage period. If it is not collected, it goes back to the seller and the buyer is refunded for the goods of that parcel; the delivery cost is not refunded in that case, since the delivery was made.

5.7. If a parcel is lost, the buyer is refunded for its goods, and if the order has no other parcels, the delivery cost too.

6. Cancelling before dispatch

6.1. A paid parcel that the seller has not packed yet can be cancelled by the buyer on the order's page in the account. Its goods are refunded.

6.2. The seller may cancel a parcel if the goods are out of stock or it cannot send them. The money is refunded in full.

6.3. If all parcels of the order are cancelled before reaching the buyer, the delivery cost is refunded too.

7. Withdrawal from goods of proper quality

7.1. The buyer may withdraw from the goods without giving a reason within 14 days of receiving the last parcel of the order (Article 24.4 of the Consumer Law). While any parcel of the order is still on its way, the period has not begun.

7.2. Goods can be returned if they have not been used and have kept their appearance, consumer properties, seals and labels.

7.3. Under Article 23 of the Consumer Law, the following goods of proper quality cannot be returned:

  • goods on the list set by the Government of the Republic of Armenia;
  • goods made to the buyer's specifications or personalised;
  • perishable goods and goods that quickly lose their properties;
  • sealed goods not suitable for return for health or hygiene reasons, once the buyer has unsealed them;
  • goods that after delivery are, by their nature, inseparably mixed with other items;
  • sealed audio and video recordings and software, once the buyer has unsealed them;
  • newspapers, magazines, books and other printed matter.

The return form warns about this before the request is sent.

7.4. How to return:

  1. On the order's page in your account press "Return goods", choose the goods and the reason "Changed my mind". Moonberry confirms receipt of the request by email right away.
  2. The seller answers within 3 days; if it does not, the request is approved automatically.
  3. Once approved, print the label from the return's page, stick it on the parcel and hand it in at any Haypost office — no later than 14 days after the request.
  4. The seller inspects the goods within 3 days of receiving them; if it does not answer, the money is refunded automatically.

7.5. On withdrawal, the buyer pays for the return shipping: its cost is shown in the return form and kept from the refund. Beyond that, the buyer is only responsible for a decrease in the value of the goods if they used them beyond checking their properties.

7.6. When the buyer has returned everything left to them of the order, the order's delivery cost is refunded too.

8. Faulty goods or wrong goods

8.1. If a defect is found in the goods, the buyer may make a claim within the warranty period, or, if none is set, within two years of receiving the goods (the Civil Code, the Consumer Law). If the wrong goods arrived, this must be reported within 14 days of receipt.

8.2. In the request, describe what is wrong and attach photos. In these cases the seller pays for the return shipping.

8.3. At their choice, the buyer may demand replacement of the goods, a proportionate price reduction, free repair of the defect, reimbursement of repair costs, or a refund — as the law provides. On the platform the request is made as a return with a refund; another demand can be made in the "Help" section of the account or by email at info@moonberry.am — Moonberry will pass it to the seller and follow up on the answer.

8.4. If the seller disagrees with the request, Moonberry's support decides the dispute after hearing both sides; this does not deprive the buyer of the right to go to court or to the authorised body.

9. Refunds

9.1. Money is refunded through the bank to the card the order was paid with. Moonberry orders the refund right after the decision; the bank credits the money within its own time — usually within 1 to 7 working days.

9.2. On withdrawal, the money is refunded no later than 14 days after the request is received; the seller may refund after it gets the goods back or the buyer shows proof of having sent them (Article 24.7 of the Consumer Law).

9.3. The buyer receives a letter about every refund; all refunds are shown on the order's page in the account.

10. Claims

10.1. Claims are accepted in the account (the "Returns" and "Help" sections), by email at info@moonberry.am and by phone at 37433060333. We reply within 10 days.

10.2. The buyer may apply to the authorised state body for consumer rights protection and to a court of the Republic of Armenia.

11. Personal data

To perform the contract, the seller and Moonberry process the recipient's name and phone, the delivery office, the contents of the order and payment details — as described in the Privacy Policy.

12. Other terms

12.1. The offer applies from the date shown on this page. A new version does not change the terms of orders already placed: each order is fulfilled on the terms of the version accepted when it was placed.

12.2. A term of the offer that contradicts the Consumer Law does not apply; an unclear term is interpreted in the consumer's favour.

12.3. The contract is governed by the law of the Republic of Armenia.
